Alright, so check this out. On November 20, I bought an OS3 negative from this seller. He didn't have the CoA from Topps Vault that went with it, but I said what the heck, it's a cool negative and maybe I can get Topps Vault to send me a new CoA.
By December 5 the item had not arrived. The seller hadn't added a tracking number by that point either. So I had no idea what was going on with the proof. I sent the seller a message on December 5, and he did not respond.
On December 7 I opened a case with eBay and indicated to eBay and to the seller that I wanted a refund. By this point it had been 17 days since I bought the proof, and I was tired of waiting for it.
The seller responded on December 10, saying that he had mailed the negative to me, but that the post office returned it to him. He ignored my request for a refund and instead re-sent the item to me (this time including a tracking number). That left me a little peeved.
I finally received a package from him on December 13, but that package contained a different item (not the one I bought). Instead of the negative, he sent me this sketch card, which he had sold to someone else and mistakenly shipped to me:

I did not want the sketch card he sent me, and I was not happy about all that has transpired to that point. Frankly, what I think happened was that the seller flaked on sending the negative to me, and only took action after I opened a case. And he didn't even give me a refund. I think he thought that if he sent me the item instead, I'd forget about my refund request.
Then yesterday (December 15), ebay closed my case and ruled in favor of the seller, saying that their records show I received a package from the seller. So, no refund for me. I appealed the decision, saying that the seller sent me the wrong item. Later last night, ebay told me I lost on appeal, and that their original decision was correct (?!?).
So apparently, as long as a seller sends you a box with a tracking number, ebay will rule in their favor. It doesn't matter what's actually in the box. I'm just lucky that in this instance, the seller sent me something of value. If he had sent me a dried dog turd, I'd be fresh out of luck. That's a pretty good scam a seller could run, seeing as he has ebay willing to look the other way on it.
Anyway, I sent the seller a message last night saying that ebay unbelievably denied my request for a refund, and that I guess that means I'm keeping the sketch card. All I wanted was a refund of my money, but I guess now I have to re-sell the sketch card instead. But hey, the other buyer bought that sketch card for like $100, so maybe I'll make a little profit on it. But I have a feeling the seller 145_man isn't going to be too happy that ebay refused me a refund. I'm guessing that will cause him to be in some hot water the buyer of that sketch card. But oh well, I tried. His issue is with ebay now.
